Order Acceptance

The contract between you and us will be formed upon collection of the ordered Products, unless we have informed you that your order has not been accepted. An order may be declined for any of the following reasons:

The product you requested is unavailable, and we are unable to fulfil your order.
We are unable to obtain authorisation for your payment.
There is an error in the pricing or description of the product.
You do not meet the eligibility criteria for placing an order, as outlined below.

If your order has been accepted through an online card payment and we subsequently determine that we cannot fulfil it, you will be notified by email. A full refund will then be issued either to the card used or by cheque. In such cases, any contract for the supply of the goods will be considered void, and AR & CM Brittain will not be held responsible for any consequential losses.

Eligibility to Order

The customer must be legally entitled to use the card on which they make the transaction. The customer is required to input correct address details including postcode and country. The order may be declined after processing should the address not be traceable or if there is a mismatch between the address, postcode, country/area of delivery.

Our Contract

These Terms and Conditions govern the supply of goods sold by AR and CM Brittain, (“we” and “us”) to the customer (“you”) these constitute the entire and only agreement between us in relation thereto.

Collection and Title

We will supply the goods in accordance with your order. Once the goods have been received by you, they will be at your risk. However, ownership of the goods will not transfer to you until full payment has been received and no other amounts are owed to us.

Until ownership passes to you, you will hold the goods in trust as our bailee. You must store the goods separately from other items at your own expense and ensure they are clearly marked as our property.

Availability

While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you we will inform you via email or telephone and offer an alternative product or refund you the price paid for such goods.

Order Cancellation

Collection dates are given in the order tracking and displayed throughout our web site. Prior to collection of your goods you may cancel your order by giving us notice of cancellation of order within 7 days of placing it. Such notice may be given by telephoning the number set out on your invoice/receipt. We will acknowledge receipt of your cancellation and refund the card account on which the goods were purchased or mail a cheque for the amount if needed.

Force Majeure

We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, failure of the carrier, adverse weather conditions, strikes, lockouts and other industrial disputes).

General

If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law.
